Title: Lecciones aprendidas de la aplicación del DL N° 30225 sobre prestaciones de adicionales de obras en carreteras

Abstract: En el presente informe de Suficiencia se expone, casuísticamente, los problemas que vienen presentando los adicionales de obra en la ejecución de la Obras Viales en el Perú, regulados por las normativas de Contrataciones del Estado. De manera específica, se detalla los criterios y análisis de la normativa y de cómo se aplicó, así como los resultados y problemas que suscitaron dentro del desarrollo contractual del proyecto de a obra: “Mejoramiento de la Carretera Chupuro - Vista Alegre - Chicche - Chongos Alto - Huasicancha”. Dado los importantes recursos económicos que se destinan a los proyectos de inversión pública en infraestructura vial, es muy relevante la evaluación de las causas que generan las prestaciones adicionales de obra identificadas en la etapa de ejecución. Sin embargo, es más importante una correcta evaluación de estas causas en la etapa de formulación del expediente técnico con la finalidad de poder reducir su impacto en el en el costo de la obra. Este costo aumenta por factores tales como: ineficientes estudios de ingeniería, presupuestos mal elaborados, mayores plazos de obra, prestaciones adicionales, controversias en la ejecución del contrato, mayores metrados, intereses, etc. El presente trabajo pretende valorar las principales causas que originan los adicionales de obra que influyen en la variación del presupuesto contractual de una obra pública de infraestructura vial. Se evalúan los factores más incidentes que generaron el incremento presupuestario durante la etapa de ejecución de la obra. Inicialmente, se mencionan los aspectos que intervienen en la concepción del proyecto vial como son: el estudio del expediente técnico, el análisis de las normativas de contrataciones del estado Ley N° 30225, los reglamentos y directivas de la Contraloría General de la República como órgano de control. Se continúa luego con la identificación de las principales causas que encarecen el presupuesto contractual que se evidencian durante el desarrollo de la obra y que en la fase de inversión debieron ser mejor evaluados. Asimismo, se describe casuísticamente los problemas que se presentaron en la aplicabilidad de la Ley de Contrataciones del Estado en la gestión de las prestaciones adicionales de obra. Con ello finalmente se recomienda alternativas que ayuden a reducir estas dificultades en base de las lecciones aprendidas y procedimientos agiles.
This Sufficiency report presents, casuistically, the problems that the work additions have been presenting in the execution of the Road Works in Peru, regulated by the State Contracting regulations. Specifically, the criteria and analysis of the regulations and how they were applied are detailed, as well as the results and problems that they raised within the contractual development of the work project: “Improvement of the Chupuro - Vista Alegre - Chicche - Chongos Alto - Huasicancha Highway”. Given the significant economic resources that are allocated to public investment projects in road infrastructure, the evaluation of the causes that generate the additional work benefits identified in the execution stage is very relevant. However, a correct evaluation of these causes is more important at the formulation stage of the technical file in order to reduce its impact on the cost of the work. This cost increases due to factors such as: inefficient engineering studies, poorly prepared budgets, longer work periods, additional services, controversies in the execution of the contract, higher metrics, interests, etc. The present work aims to assess the main causes that originate the additional works that influence the variation of the contractual budget of a public road infrastructure work. The most incident factors that generated the budget increase during the execution stage of the work are evaluated. Initially, the aspects that intervene in the conception of the road project are mentioned, such as: the study of the technical file, the analysis of the state contracting regulations Law No. 30225, the regulations and directives of the Comptroller General of the Republic as control body. It then continues with the identification of the main causes that increase the cost of the contractual budget that are evident during the development of the work and that in the investment phase should have been better evaluated. Likewise, the problems that arose in the applicability of the State Contracting Law in the management of additional work services are described casuistically. With this, alternatives are finally recommended that help reduce these difficulties based on the lessons learned and agile procedures.
